Example Terms of Service for Publishers
1. General Terms and Conditions
The terms of sale and purchase for (NEWSPAPER NAME) digital products, including digital subscriptions and one-time purchases, are available on this page.
At any time, we reserve the right to change the content and availability of any digital product.
A digital product account’s user name and password can only be used by one individual.
You agree to receive electronic alerts from us at the email address you supply. Unless the applicable laws explicitly require a different form of communication, you agree that all notices, disclosures, and other communications that we give to you electronically fulfill any legal requirement that such communications be in writing. You acknowledge that you have the capacity to store such electronic communications in a way that allows you to access them in their original form.
If any portion of these Terms of Sale is found to be invalid, void, or unenforceable for any reason, that section will be deemed severable, and the legality and enforceability of the other sections will not be affected.
2. Payment and Processing
Your order will be processed as soon as feasible. While your payment details are validated, there may be a delay in the activation of your goods.
All major credit cards are accepted. At any time, we reserve the right to refuse any order or purchase.
Your subscription, product, or access will be canceled if your initial payment authorization is later revoked.
All payments are nonrefundable unless otherwise stated in the Cancellation and Refunds of Digital Subscriptions section.
Visit the “My Account” section to see or change your payment method.
Your credit card provider may send us updated credit card information (a new credit card number or an updated expiration date). Your credit card issuer chooses whether or not to send us updated credit card information. The distribution of your updated credit card information is not our responsibility. You may be able to opt out of the update service if your credit card issuer allows it. It is your duty to inquire about your right to opt out of the update service with your credit card issuer.
3. Pricing
The pricing of a digital product will be made explicit during the checkout process. You agree to pay the amount listed on the website at the time you place your order, including any applicable taxes. You also agree to the billing frequency specified when you placed your order.
At the time of the order, the discount eligibility is determined. Discounts can’t be applied backwards.
Unless otherwise specified, all prices are in US dollars.
We reserve the right to change our prices and fees at any moment. We will notify you if the normal rate of a product changes from what was stated at the time of your order. You will have the option to accept the revised pricing or cancel your subscription or purchase from that point forward.
Taxes that apply may differ. We are unable to tell you of changes in applicable taxes in advance.
If we determine, in our sole judgment, that a claimed price or other material information is incorrect, we are not obligated to give you the goods at that price and have the right to cancel, terminate, or not process orders (including accepted orders). If payment has already been made, we will notify you of the error and give you the option to cancel your order and receive a refund.
You may not have access to all portions of the digital product as part of your subscription, and you may have to pay additional fees to have full access. These additional fees will be noted clearly.
You may be charged additional fees from third-party service providers when you use your digital product, such as telecommunications fees, data fees, or service provider fees. Any additional charges are your responsibility.
Please notify us if you feel someone else has used your account or if you are being charged for a product you do not have.
We may run promotions from time to time. Each promotion’s particular terms are stated at the time the promotion is offered. Each promotion could be unique. Promotions are not combinable.
When you sign up for a campaign, you must give your payment information. Your subscription will automatically renew at the rates displayed at the time of purchase at the end of the promotion.
We will not notify you when the promotion is due to expire, nor will we notify you when your promotional pricing has expired. You must tell us before the promotion ends to cancel and avoid being charged.
4. Billing
Your payment method will be charged or debited at the start of your subscription or, if applicable, at the end of your free trial period. The billing cycle mentioned at the time of your order will be followed.
Visit the “My Account” section to see details about your billing cycle.
For subscriptions that are auto-renewing, we’ll use the payment method that’s currently linked with your account to renew your subscription. If you redeem a gift subscription that is auto-renewing, your current payment method will be used for the renewals. In the “My Account” section, you can see your current payment method.
You will not be advised in advance of upcoming renewals in the vast majority of circumstances, and you expressly agree to forgo the application of New York General Obligations Law section 5-903 and any comparable statutes. For further information about canceling, please see the Cancellation and Refunds of Digital Subscriptions section.
We will charge or debit your payment method at the time of purchase when you make a one-time purchase (for example, a subscription sponsorship or a single product such as an article from our archives or a gift subscription).
5. Cancellation and Refunds of Digital Subscriptions
You can cancel an active auto-renewing subscription by visiting the “My Account” page and navigating to the “Subscriptions” tab. From there, you can click the “Cancel” button next to the subscription you’d like to cancel.
When you cancel a subscription, you’re merely canceling future costs linked with it. You may cancel at any time, however your cancellation will only take effect at the conclusion of your current paying term.
Cancellations take effect at the beginning of the next payment period. For the current billing cycle, there will be no refund. For the balance of the current paying term, you will enjoy access to and benefits from your product.
At our sole discretion, we reserve the right to offer refunds or credits. We are not obligated to give the same or comparable refunds in the future if we issue a refund.
At any moment, we have the right to make modifications to our digital goods. You will not receive a refund if we temporarily decrease or eliminate the fee for material or access that you are presently paying for under other terms.
We retain the right to cancel your subscription or product at any time, for any reason, with or without warning or additional obligation. In this case, you will be eligible for a refund. You will not be refunded if some or all of our digital items are temporarily unavailable. At our sole discretion, we reserve the right to offer refunds or credits. We are not obligated to give the same or comparable refunds in the future if we issue a refund.
During the promotional time, some promotions may not allow cancellation. You agree to the cancellation and refund policies specified during the purchasing process.
One-time purchases cannot be canceled or reimbursed.
